The Swiss Government Agency “Armasuisse” has won a trademark case in the Indian Court against an Indian garment manufacturer.
The stance by Armasuisse was that use of the white cross on a black background was not an issue but inclusion of the word Swiss Military, could be seen as being misconstruing the origin of the product being from Switzerland. The Delhi High Court agreed with the reasoning in that allowing such marks to be registered would be contrary to India Statutory Law and the trademark applications of the impugned marks are rejected.
