🔸 Morinaga Milk Industry Co., Ltd. (the Applicant) applied to register their trademark in Classes 29 and 30 including milk products and coffee beverages. Starbucks Corporation then opposed the registration based on three relative grounds and two absolute grounds of refusal. Essentially, the IP Adjudicator rejected Starbucks’ arguments that the green-black-white colour scheme and layout of the marks within concentric circles rendered the marks similar and there is no misrepresentation.
