๐Ÿ“ Passing off refers to the act of making false representation to make others from believing that the goods or services are those of another. Usually, this happens when someone tries to gain profits by riding on an existing famous brand. In common law countries such as the United Kingdom, Australia, New Zealand, Malaysia included, the law of passing off is a common law tort which can be used enforced unregistered trademark rights. The act of passing off may be referred to as an infringement under the Malaysia Trademarks Act 2019 under Schedule 24.
