Nespresso USA Inc. has sued Peet’s Coffee in the Manhattan federal court claiming that Peet’s coffee pods violate Nespresso’s capsule design trademark. Nespresso had claimed that the espresso pod is ‘nearly identical’ to the espresso pod sold by their company with same ‘frustoconical’ tops and opaque colour and that it is likely to cause confusion among the consumers.
