It is entirely up to the copyrights owners’ discretion whether to enforce their rights against an infringer or not. Unlike trademark rights which is capable of being diluted through misappropriation or unauthorized use, infringement of a copyright will not hurt the owners’ proprietary rights. This is why copyright holders may (and often do) turn a blind eye to fan works, such as fan fiction and fan art.
