® Trademark rights are acquired through use and hence the use of the trademark will make the mark more distinctive and powerful in nature. There is, however, a process where a prospective mark owner can “reserve” a mark that he or she intends to use in the future, even though he is not currently using it. In such cases, it is advisable to use the trademark within 3 years of the registration of the trademark to avoid cancellation from non-use. Thus, usage of the trademark is a vital and equally important aspect for registration and to maintain the registration alive throughout the course of the business.
