โžก๏ธRecently, the US Supreme Court has agreed to hear a dispute between the whiskey manufacturer Jack Daniels (Jack Danielโ€™s Properties Inc.) and a dog toy company (VIP Products LLC) that sells a chew dog with the appearance of a whiskey bottle similar to Jack Danielโ€™s, otherwise called โ€œBad Spanielsโ€.

Some of the features on the chew toy, where the name Jack Danielโ€™s is replaced with โ€œBad Spanielsโ€, the words โ€œOld No. 7 brandโ€ and โ€œTennessee Sour Mash Whiskeyโ€ are replaced with โ€œThe Old No. 2 on Your Tennessee Carpetโ€ and on the Jack Danielโ€™s bottle 40% alcohol by volume is replaced with โ€œ43% Poo by Vol.โ€ and โ€œ100% Smelly.โ€

VIP Products LLC has raised the defence of parody and the legal issue here would be whether parody of a companyโ€™s brand/trademark is allowed under US trademark law. The case is expected to be heard in February or March 2023.
