Replica cars have vexed the car industry for a long time. In the case of Jaguar Land Rover v Creare Form AB et al, PMT 15833-18, an interesting area of law was brought up. Can a work of applied art, created in the UK in 1951, enjoy copyright protection in Sweden in 2021? This case concerns Jaguars most iconic sportscar also known as Type C. The defendant argued that the Plaintiff being Jaguar Land Rover has always remained passive in the production of replicas of their car. However, the court was not convinced with such argument and grant claims of prohibition and penalty.
