📰 Under the new Trademark Act 2019, there are two grounds of refusal namely Absolute and Relative grounds of refusal. Absolute grounds of refusal include marks that are deemed descriptive in nature or which have become customary and generic to the general public and hence cannot be monopolized by one individual or entity. Relative grounds of refusal comprise objection based on earlier similar or identical trademarks and well-known trademarks.
