Attempting to patent a formulation is challenging, but not impossible. A formulation patent is valuable to the patent holder when it is sufficiently broad or strategic for ensuring that the patent cannot be avoided by a simple tweak to the formulation. With a patent, inventors or business owners may prohibit competitors from manufacturing an identical or similar product for a duration of time in exchange of a release of manufacturing process or formulation of a cosmetic product to the public domain.
