📂 It was held by the court that “ChipsPlus” was indeed an infringement of “ChipsMore” as they were similar marks for identical goods and is likely to deceive and confuse to public. The brand “ChipsMore” is a brand well known in Malaysia and has substantial goodwill and reputation in the brand. The appearance of ChipsPlus is strikingly similar to ChipsMore including the packaging colours, fonts and the words are phonetically identical to each other. The court was therefore in the opinion that the British manufacturer will suffer damage (loss of business) should the Malaysian company was allowed to continue the production of the biscuit.
