©️ Art Rogers, a professional photographer took a black and white photograph of a couple holdings a line of puppies and sold the photo for use in greeting cards and other products. Subsequently, another renowned artist Jeff Koons used the photograph to create set of sculptures based on the image; Koons sold several of the statues making a significant profit. Rogers sued Koons for copyright infringement with Koons responding by claiming fair use by parody. The court held that the two images/artworks are very similar and that any ordinary person would be able to recognise the copying; thus, it was held that the sculpture was a copy of Rogers’ work, rejecting Koons defence of parody.
