📂 In the case of Rihanna Fenty vs Arcadia Group Brands Ltd, Topshop, part of Arcadia Group had sold T-shirt bearing image of Rihanna Fenty (commonly known as Rihanna) without her permission.
⚖️ The Court of Appeal (COA) of England and Wales ruled that the sale by the well-known retailer Topshop of a T-shirt bearing image of the famous pop star, Rihanna without her permission amounted to passing off and was therefore unlawful.
✨The reason behind this is because Rihanna is a global superstar and that she had previously collaborated with other high street retailers, including Topshop. As such, selling of the T-shirt without Rihanna’s approval would amount to misrepresentation that Rihanna had endorsed it.
